Filmtec

Filmtec NZ Limited (Filmtec) provides services on the following terms and conditions:

Independent Contractor

As Filmtec is an independent contractor, no employer and employee relationship applies.

Limited of Liability

Filmtec shall not be liable to the client in contract, tort, and negligence or otherwise for:

• Any losses, which are not reasonably foreseeable on acceptance of the instructions;
• Any indirect or consequential or economic loss whatsoever, including but not limited to: loss of business, use, profits, future contracts or anticipated savings;
• Any loss or damage arising from any delay in completion of the project from whatever cause;
• Any injury or damage arising from any defect or failure of any kind whatsoever in any equipment.
• In any event Filmtec’s total liability for any losses will not exceed the amount paid by the client to Filmtec in the previous 12 months for the services
• Filmtec’s fees have been calculated on the basis that Filmtec can exclude or limit liability as set out in these Terms and Conditions. The client confirms that it will bear itself (or insure against) any loss for which Filmtec have excluded or limited liability.

Insurance

The client shall insure that full production insurance cover is maintained throughout to cover any equipment other articles provided by the client, as well as any equipment or gear hired from, or otherwise provided by Filmtec. Prior to the commencent of the contract, the client will supply a certificate from its insurer.

Variation

The client and Filmtec shall only agree to any variation to these Terms and Conditions in writing.

Governing Law

These Terms and Conditions shall be subject to and constructed and interpreted in accordance with New Zealand law.
